1. Acceptance of Terms

By using the Pivix platform ("Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to the Terms, you must not use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Service Description

Pivix provides a cloud-based software platform that enables users to create and publish interactive scorecards, quizzes, and marketing funnels to collect leads and qualify customers. Users can customize templates, build pages, analyze data, and integrate third-party marketing tools. The Service is provided on a subscription basis and includes updates, improvements, and bug fixes. We reserve the right to modify the Service at any time, including the addition or removal of features or functionality. Any such changes will be communicated in advance when possible.

3. User Accounts

To access certain features of the Service, you must register and maintain a user account. You agree to:
  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your password and account credentials.
  • Notify us immediately of any unauthorized access or breach.
  • Be solely responsible for all activities that occur under your account.

4. Subscription & Payments

Pivix operates on a subscription-based pricing model:
  • Billing:Subscriptions are billed in advance on a monthly or annual basis. You agree to pay the fees in accordance with your selected plan.
  • Auto-renewal:Your subscription will automatically renew unless canceled before the end of the current billing period.
  • Refunds:Refunds are only issued where legally required. Free trials are offered for evaluation purposes.
  • Cancellation:You may cancel your subscription via your account settings. Access to paid features will end at the end of your billing cycle.
  • Taxes:Fees are exclusive of applicable taxes. You are responsible for any taxes related to your use of the Service.

5. User Content

"User Content" refers to any data, text, images, files, or other content uploaded or generated by you in connection with the Service.
  • You retain full ownership of your User Content.
  • You grant Pivix a non-exclusive, worldwide license to use, host, and process your content solely to operate and improve the Service.
  • You are solely responsible for your content, including its legality and compliance with applicable laws.

6. Intellectual Property

All intellectual property rights in and to the Service, including software, design, trademarks, and branding, remain the exclusive property of Pivix.
  • You may not copy, modify, distribute, sell, or lease any part of the Service.
  • You may not reverse engineer or attempt to extract the source code.
  • You may not use our trademarks without prior written permission.

7. Data Protection & Privacy

Your use of the Service is subject to our Privacy Policy. If you process data on behalf of EU data subjects, you must enter into a Data Processing Agreement (DPA) .
  • We implement industry-standard security measures.
  • You are responsible for complying with data protection laws applicable to your customers and leads.

8. Availability & Support

  • We strive for 99.5% uptime but do not guarantee uninterrupted service.
  • Planned maintenance will be communicated in advance.
  • Support is available via email at support@pivix.io. We aim to respond within 24 hours during business days.

9. Prohibited Use

You agree not to:
  • Use the Service for illegal or fraudulent purposes.
  • Transmit malware, spam, or phishing.
  • Abuse system resources or disrupt the Service.
  • Attempt to gain unauthorized access to other users' data or the underlying infrastructure.

10. Limitation of Liability

To the fullest extent permitted by law:
  • Pivix is not liable for indirect, incidental, or consequential damages.
  • Our total liability for any claim is limited to the amount paid by you in the 12 months preceding the claim.

11. Termination

  • To the fullest extent permitted by law:
  • We may suspend or terminate your account if you violate these Terms.
  • Upon termination, we may retain your content for 30 days, after which it may be deleted permanently.

12. Modifications to Terms

We may revise these Terms at any time. If we make material changes, we will notify you via email or through the Service. Continued use of the Service constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of United Kingdom. Any disputes will be resolved in the courts of London, unless applicable law requires otherwise.

14. Beta Features Disclaimer

Pivix may offer access to beta or experimental features. These are provided "as is" with no guarantees of reliability, functionality, or support. Use of beta features is at your own risk and may be discontinued at any time.

15. Third-Party Services Disclaimer

Pivix integrates with third-party services such as email marketing tools, CRMs, and analytics platforms. We are not responsible for the content, policies, or reliability of any third-party services. Your use of such services is subject to their own terms and policies.

16. Data Processing Agreement (DPA)

If you collect or process personal data of EU residents using the Service, you must comply with GDPR. A standard DPA is available at [https://www.pivix.io/dpa].
  • It defines our obligations as a data processor.
  • You must review and sign the DPA electronically to maintain compliance.
